How To Extend A Spousal Open Work Permit In Canada
If a Spouse Open Work Permit (SOWP) is close to expiry, an extension may be possible if the applicant is still in Canada and continues to qualify based on the principal applicant’s valid status. Extensions are generally filed as in-Canada work permit applications and should be submitted before the current permit expires to help maintain status while IRCC makes a decision. Who can apply for a SOWP Extension?
A SOWP extension may still be possible from inside Canada if the applicant continues to qualify as the spouse or common-law partner of a principal temporary resident, most commonly a foreign worker, though in some cases the principal applicant may instead be an international student who still holds valid status in Canada. IRCC will generally expect proof that the relationship remains qualifying and that the principal applicant’s status, along with the conditions that supported the original SOWP, remains valid, including proof of a valid study permit where applicable. The key question after January 21, 2025 is when extensions are still allowed under the updated rules.
IRCC states that in-Canada family members may still be able to extend an open work permit after January 21, 2025, if all of the following conditions are met:
- the applicant is in Canada
- the current work permit is valid for a shorter period than the principal applicant’s permit
- the extension application is submitted before the current work permit expires
In practical terms, extensions are most straightforward when the applicant remains eligible for an open work permit. This is especially true when the SOWP was issued for a shorter period than the spouse or partner’s status document, and the extension is being requested to align the validity periods, subject to limits such as the principal applicant’s permit validity and the spouse’s passport or biometric validity.
When can you apply for a SOWP Extension?
The extension application should be submitted before the current work permit expires, if the applicant still needs to apply for an open work permit from inside Canada. IRCC recommends applying at least 30 days before expiry to help reduce the risk of falling out of status.
If the extension is submitted before expiry and the applicant remains in Canada, work can generally continue under the same conditions as the original permit until IRCC makes a decision (often referred to as maintained status). Where the principal applicant holds a Post-Graduation Work Permit, eligibility should also be reviewed under the rules for spouses of Post-Graduation Work Permit holders.
Can I extend my SOWP if it is already expired?
Not always — it depends on whether the application was submitted before the permit expired and, if not, how long ago it expired.
- If the application was submitted before expiry: maintained status may apply, which usually allows the applicant to remain and work in Canada under the same permit conditions while IRCC processes the Spousal Open Work Permit extension, as long as the applicant remains in Canada. The online submission confirmation or payment receipt should be kept as proof in case an employer requests it.
- If the permit expired less than 90 days ago and no extension was submitted in time: an extension is no longer possible, but restoration of worker status and a new work permit application may still be available. During the restoration period, work is not allowed until IRCC approves both the restoration and the new work permit.
- If the permit expired more than 90 days ago: restoration from inside Canada is generally no longer available, and leaving Canada to apply again may be necessary, depending on the situation.
Because timing can directly affect both legal status and the ability to keep working, current processing times should always be reviewed before applying, and eligible extensions should be filed as early as reasonably possible.
