What is an example of a conjugal partner?

A conjugal partner is someone who is in a committed, exclusive, marriage-like relationship but cannot marry and cannot live with their partner for 12 continuous months due to reasons entirely beyond their control. IRCC created this category for couples who would normally qualify as spouses or common-law partners, but who cannot meet those requirements because of real, documented barriers.

Example of a Conjugal Partner Situation

A Canadian citizen is in a long-term, committed relationship with a partner living abroad. The couple maintains a stable, genuine relationship through daily communication, shared financial responsibilities, and future plans. However, significant barriers prevent them from becoming spouses or common-law partners.

The foreign partner has been repeatedly refused Canadian visitor visas, making it impossible for the couple to live together for 12 months in Canada. Travel to each other’s countries may also be limited due to strict entry rules or regional instability, preventing long-term stays elsewhere.

Marriage is not possible in the partner’s home country due to restrictive laws or administrative requirements. For example, marriage to a foreign national may require government approval that is rarely granted, or local laws may require one partner to convert religions or terminate a previous civil status that the country does not legally recognize.

Because immigration restrictions prevent cohabitation and legal barriers prevent marriage, the couple cannot meet the requirements for spousal or common-law sponsorship. In such cases, they may qualify for conjugal sponsorship.
