The Canada Spousal Open Work Permit (SOWP) is designed to let eligible spouses or common-law partners work for almost any employer in Canada. Under this program, the Applicant (the spouse or common-law partner seeking to work) is granted work authorization based on the qualifying status of their partner – who is either a Sponsor (Canadian Citizen or Permanent Resident), a Foreign Worker or an International Student.
In 2025, the SOWP landscape changed dramatically. The most sweeping restrictions took effect on January 21, 2025, tightening eligibility and putting far more weight on the partner’s situation at the exact time the application is submitted. The first category is the spouse of a Sponsor, where applicants under Inland Spousal Sponsorship can request a work permit while their PR application is processed, provided the couple resides together.
The second category covers spouses of a Foreign Workers, where approval requires the partner to work in a TEER 0 or 1 (or priority TEER 2/3) role and have at least 16 months of validity remaining on their permit. This 16-month rule is vital for PGWP holders, who must now prove they hold a qualifying high-skilled or priority occupation – simply holding a valid permit is no longer sufficient to qualify a spouse for an SOWP.
The third category is the spouse of an International Student; as of 2025, eligibility is restricted to partners of those in Master’s (16+ months), Doctoral, or select Professional degree programs.
