How does the conjugal partner sponsorship program work in Canada?

The conjugal partner sponsorship program is a special, exception-based pathway within Canada’s Family Class immigration system. It is intended for couples who are in a long-term, committed, marriage-like relationship but who cannot get married and cannot live together for 12 continuous months because of significant barriers beyond their control. Since this is not the standard route, IRCC evaluates these applications very carefully and expects a high level of evidence. If you’re unsure whether you qualify, experienced Canadian immigration consultants can help you assess your situation. You can also review standard pathways on our Spousal Sponsorship page.

The process functions similarly to other sponsorship categories but with stricter requirements. The sponsor must be a Canadian citizen or permanent resident, at least 18 years old, and able to support their partner financially without receiving social assistance. Citizens living abroad may sponsor a conjugal partner if they can show they plan to return to Canada once their partner becomes a permanent resident.

To be eligible, the couple must prove:

  • A genuine, committed, and exclusive relationship
  • Serious barriers preventing both marriage and cohabitation (e.g., immigration restrictions, legal or cultural limitations, religious barriers, or laws restricting same-sex relationships)
  • Ongoing efforts to maintain the relationship despite these barriers

Evidence often includes communication records, proof of attempts to visit or live together, financial support, sworn declarations from friends or family, and documents showing failed attempts to overcome the obstacles .For more insight into how IRCC evaluates these applications, see our related FAQ: How does IRCC assess conjugal partner sponsorship applications?

IRCC approves conjugal sponsorship only when no other route is realistically available. If approved, the conjugal partner becomes a permanent resident and can live and settle in Canada. For guidance or support, you can book an appointment or review our Immigration Consultant Fees page.
