When to apply for a spouse open work permit (SOWP) in Canada?
Last updated: January, 2026
The best time to apply for a spouse open work permit depends on the principal applicant’s status and where the spouse is located. In general, a spouse should apply as soon as they meet eligibility requirements and have all required documents ready. A full overview of eligibility and timing scenarios is available on the Spousal Open Work Permit page.
You may apply for a spouse open work permit in the following common situations:
- When the principal applicant has received a valid work permit and is employed in an eligible occupation
- When the principal applicant has started full-time studies at a designated learning institution (DLI)
- When applying together with the principal applicant, either from inside or outside Canada
- After entering Canada as a visitor, provided you still meet eligibility requirements and hold valid temporary status
Spouses of permanent residence applicants often apply for an open work permit after a sponsorship or PR application has been submitted, but it is important to note that work permit and PR applications are assessed separately. This is explained in more detail on the Spousal Sponsorship Program page.
Applicants should avoid waiting until the principal applicant’s status is close to expiry. Applying earlier helps reduce the risk of refusal and may allow the spouse to benefit from maintained status if they are already in Canada.
