Why is a spouse open work permit refused in Canada?

A spouse’s open work permit (SOWP) may be refused when IRCC determines that eligibility requirements are not met or the application is not sufficiently supported by evidence. While spouse open work permits are commonly approved, refusals usually occur for specific and avoidable reasons. One of the most common refusal reasons is ineligibility of the principal applicant. A spouse open work permit may be refused if the principal applicant:
- Does not hold a valid work or study permit
- Is not employed in an eligible TEER 0–3 occupation (for foreign workers)
- Is not enrolled full-time at a designated learning institution (DLI) (for students)
Another frequent reason is insufficient proof of a genuine relationship. IRCC closely examines whether the marriage or common-law partnership is real and ongoing. Applications may be refused if documentation such as marriage certificates, proof of cohabitation, or shared financial evidence is missing, inconsistent, or weak.
Incomplete or inaccurate applications are also a major factor. Missing documents, incorrectly completed forms, or unclear explanations can result in refusal even when eligibility exists. This is especially important for spouses applying while a permanent residence application is in progress under the Spousal Sponsorship Program, as sponsorship and work permit applications are assessed separately.
Refusals may also occur due to temporary residence concerns, including unclear travel history, past refusals, overstays, or failure to demonstrate compliance with Canadian immigration laws.
