LMIA-Exempt Work

Known as LMIA-exempt work, these opportunities fall under specific categories where the employer is not obligated to prove that no Canadian citizens or permanent residents are available to fill the position. These exemptions are primarily granted under the International Mobility Program (IMP), which prioritizes broader economic, cultural, and social interests.

LMIA-exempt work permits are typically issued when the employment relationship benefits Canada in ways that go beyond the labor market. Common categories include intra-company transferees, participants in international agreements (such as CUSMA and CETA), and individuals who bring significant cultural or social value. Other examples involve Open Work Permits, such as those issued to spouses of skilled workers or international students, post-graduate work permit holders, or Bridging Open Work Permit applicants transitioning to permanent residency.

The LMIA exemption also supports charitable and religious workers, individuals on reciprocal employment programs, and those entering under Canadian interests exemptions — including urgent or exceptional circumstances. Many of these pathways are temporary in nature but can serve as stepping stones to permanent residence through programs such as Express Entry or a Provincial Nominee Program (PNP).
